4.6. У випадку порушення своїх зобов'язань за попереднім договором Сторони несуть відповідальність, визначену попереднім договором та чинним законодавством України. Порушенням зобов’язання є його невиконання або неналежне виконання, тобто виконання з порушенням вимог, визначених чинним законодавством України та Попереднім договором.
4.7. Сторони дійшли згоди визначити наступні наслідки неналежного виконання Стороною-2 умов Попереднього договору щодо сплати Забезпечувального платежу в строки, визначені п. 4.2, цього Попереднього договору, а саме:
