Вищезазначені обставини дали податковому органу підстави для висновку про "без товарність" господарських операцій по придбанню підприємством "Укрзалізничпостач" товарів, і як наслідок - про безпідставність віднесення сплачених за товари коштів на валові витрати підприємства та до сум податкового кредиту.
Підприємством "Укрзалізничпостач" вказані податкові повідомлення-рішення були оскаржені до суду. Рішенням Окружного адміністративного суду м. Києва, залишеним без змін ухвалою апеляційного суду, було відмовлено в задоволенні адміністративного позову підприємства "Укрзалізничпостач" до ДФС про скасування податкових повідомлень-рішень (справа № 826/14818/151. На сьогодні подана касаційна скарга до Вищого адміністративного суду України та відкрито касаційне провадження (кінець травня). Судове засідання не призначено.
