4.1. Для забезпечення виконання свого зобов'язання щодо укладання Основного договору Сторопа-2 зобов’язується сплатити Забезпечувальний платіж у розмірі 937 554,75 грн. (дев'ятсот тридцять сім тисяч п'ятсот п’ятдесят чотири
4.1.1. Сторона-2 має право сплачувати Забезпечувальний платіж частинами протягом строку вказаного у договорі.
4.2. Оплата3абезпечувалыіого платежу здійснюється шляхом перерахування грошових коштів в українській гривні Стороні-1 не пізніше 06 листопада 2014 року : Товариство з обмеженою відповідальністю «Рент-Сервіс», код підприємства згідно з-Єдиним державним реєстром підприємств та організацій України 35917915, п/р 26007010974171 MFO 300023.
4.3. Датою оплати Забезпечувального платежу та/ або його частини та інших платежів, вважається дата зарахування грошових коштів на банківський рахунок Сторони-1. Відповідно до норм Закону України «Про переказ коштів в Україні» №2346-ІІІ від 05.04.2001р. грошові кошти повинні бути внесені.
4.4. Сторони підтверджують, що Забезпечувальний платіж, який Сторона-2 сплачує Сороні-1 на підставі цього договору не є авансом, попереднього оплатою, повторною фінансовою допомогою та не с видом забезпечення розумінні ч. 1. ст. 546 Цивільного кодексу України.
4.5. При укладанні Сторонами Основного договору Сторона-1 повертає Забезпечувальний платіж, отриманий договором, на розрахунковий рахунок Сторони-2 в день укладання Основного договору. За домовленістю Сторонами Основного договору, Сторони мають право провести зарахування зустрічних взаємних вимог, яким зобов'язання Сторони-1 щодо повернення суми Забезпечувального платежу, сплаченого Стороною-2 , договором, зараховуються в рахунок сплати платежу Сторони-2 за Основним договором.
