Щодо вимог фірми «Нібулон» на 175 млн. грн.
Зазначена справа є пов’язаною з попередньою справою. Сума позову складається зі збитків 60 млн грн. та штрафу 60 млн грн., а також 50 млн. грн інфляції та 5 млн грн 3% річних. Збитки фірми «Нібулон» полягають в тому, що Укрзалізниця стягувала з фірми «Нібулон» ПРОТЯГОМ 2012-2014 рр. вартість перевезення за підвищеним тарифом як за перевезення експортних вантажів, хоча як встановлено Антимонопольним комітетом, цього не мала права робити. Тому фірма «Нібулон» вимагає повернути їй різницю між тарифом для експортних перевезень та тарифом для внутрішніх перевезень. Провадження в цій справі порушено, але справа ще не розглядалася. Результат вирішення цієї справи буде залежати від результатів перегляду Антимонопольним комітетом свого рішення, про яке йшлося вище.
Нами подано заяву про застосування позовної давності, у разі відхилення якої заявлена до стягнення сума буде стягнута.
